Richard D. Jones, Jr. co-authored "A Practical Analysis of HCQIA Immunity," which appears in the fall 2009 issue of DRI's In-House Defense Quarterly. To encourage peer review, the Health Care Quality Improvement Act (HCQIA) provides immunity from damages to the hospitals, clinics, physicians, and others who perform this important function. Despite this immunity, litigation initiated by physicians in response to restrictions or limitations on their privileges persists, and these dissatisfied physicians continue to test the limits of HCQIA immunity. The article is in large part predicated on a recent case decided by the United States Court of Appeals for the Fourth Circuit, Wahi v. Charleston Area Medical Center, 562 F.3d 599 (4th Cir. 2009), which affirmed the district court's grant of summary judgment based on HCQIA immunity. The article offers valuable guidance to counsel handling physician peer review, as well as litigation arising from peer review activities. |

Has the rumor of preemption's death been greatly exaggerated? On June 18, 2009, the West Virginia Supreme Court of Appeals issued its decision in Morgan v. Ford Motor Co., No. 34139, 2009 W. Va. LEXIS 63 (W.Va. June 18, 2009), affirming summary judgment and concluding that the trial court did not err in finding federal preemption in an automotive product liability case involving the choice of materials for side window glass. In a unanimous decision, the Court ruled that the state tort claim at issue was preempted "because the NHTSA gave manufacturers the option to choose to install either tempered glass or laminated glass in side windows of vehicles [pursuant to Federal Motor Vehicle Safety Standard (FMVSS) 205] permitting the plaintiff to proceed with a state tort action would foreclose that choice and would interfere with federal policy." Bumgarner has served as the Firm's Manager since 2002. During his tenure Bumgarner has managed personnel, technology, marketing, office expansions and the firm's accounting. Over the years Bumgarner has established himself as a true strategic asset of the firm. Bob Coffield was recently featured on a television segment for the show "Lifeline" on Health Information Exchange and Health 2.0. Lifeline is a weekly 30 minute public television program focusing on a variety of healthcare, Medicare and healthy living topics for West Virginians. The show is produced by West Virginia Medical Institute ("WVMI"). Marc McCombs, WVMI's Director of Corporate Communications, hosts the weekly show. Lifeline airs on the West Virginia Library Television Network in over 200,000 households throughout the State and can be found on Suddenlink Channel 17 in the Charleston area. Straightforward Approach Secured Victory in WVU v. Rodriguez Case
|
FOR IMMEDIATE RELEASE (Charleston, W. Va.) - If the recent lawsuit between West Virginia University and its former head football coach, Rich Rodriguez, were compared to a gridiron contest, the game plan developed and executed by its law firm would not have been characterized as flashy, gimmicky or razzle-dazzle. Instead, the strategy employed by the legal team of Flaherty, Sensabaugh & Bonasso, PLLC, (FSB) was a straight-up-the middle, focused ground game, executed in the forward-pressing fashion of the hurry-up offense. "All along we believed that the facts of the case and the letter of law were on our side," explained Member Attorney Jeff Wakefield, "A fundamental philosophy in all of our litigation is that we never take a legal position that we not prepared to stand behind. That is a basic approach, no doubt, but it was a very effective approach in this case." The FSB legal team and its client, WVU, knew from the start that the facts were, indeed, in their favor. In the end, the straightforward and unwavering litigation approach employed by FSB led to the former coach to concede to a full payment of $4 million. Yesterday, the negotiated settlement became reality, as the agreed-upon first payment of $2.5 million from the Rodriguez side was received right on schedule via wire transfer of funds from the University of Michigan. On February 6, 2008, Mark Robinson, Salem Smith, and Ryan Brown performed a mock trial for the West Virginia Health Care Association. The mock trial was based upon a nursing home case involving an injury to an elderly patient. Mr. Smith, a member of the health care group, served as counsel for the patient, and Mr. Robinson, also a member of the health care group, served as counsel for the nursing home. The American Bar Association Young Lawyers Division Appoints Alaina N. Crislip as District Representative

The American Bar Association Young Lawyers Division appointed Alaina N. Crislip, an associate in the Charleston office, as a District Representative for District 18 covering Ohio and West Virginia. As District Representative, Ms. Crislip will serve as a liaison between the local affiliates of the American Bar Association in Ohio and West Virginia and the Young Lawyers Division. Ms. Crislip will also assist in the organization of affiliates and encourage utilization of Affiliate Assistance Team members, provide hands-on assistance to Affiliates in the planning and implementation of Young Lawyers Division programs and projects, assist in the certification of delegates to the Mid-Year and Annual Meeting and provide input and voting assistance on recommendations and resolutions used in the adoption of policy positions by the Young Lawyers Division and the American Bar Association. Ms. Crislip will also provide input on Young Lawyers Division planning and development issues and assist in Disaster Legal Services programs within District 18 in partnership with FEMA.
