Tom Flaherty and Nate Tawney obtained a defense verdict in a legal malpractice case where it was alleged that an attorney negligently advised clients on estate planning issues. The estate sought more than four million dollars in alleged damages, claiming that the deceased should have been recommended an estate planning vehicle known as an "irrevocable trust," and that the failure of such recommendation resulted in substantial estate tax consequences. Following a four-day trial, the jury deliberated for less than an hour and specifically found that the attorney did not breach the requisite standard of care.
