| The plaintiff alleged that the defendant general surgeon’s decision to perform a laparoscopic cholecystectomy activated a dormant virus which contributed to the patient’s death. The defense contended that defendant met the standard of care by laparoscopically removing the patient’s gallbladder and performing a biopsy of patient’s liver. After a three day trial, the six person jury returned a unanimous verdict in favor of the general surgeon finding that he had met the appropriate standard of care.
