| Stephen Brooks and Robert James obtained a defense verdict in a medical malpractice case tried in Brooke County. Plaintiffs alleged that our client, a gastroenterologist, performed a colonoscopy in such a substandard manner that a colon perforation occurred. They alleged that preparation was inadequate, that the plaintiff’s blood level was too low for the procedure, and that the perforation was not addressed in a timely manner. As a result the Plaintiff died. Following a six day trial, the jury deliberated for about two hours before unanimously finding that the gastroenterologist did not breach the standard of care.
