K. Tawney succeeded in obtaining summary judgment in actions
by five former employees against their employer for alleged violations
of the Prevailing Wage Act. These plaintiffs claimed over $500,000
in damages for deficient payment in prevailing wage, interest,
and statutory penalty for their work installing computer systems
wiring. Judge Goodwin, sitting for the United States District
Court for the Southern District of West Virginia, granted the
employer's motion for summary judgment because the installation
of computer systems wiring did not constitute "construction" within
the meaning of the Prevailing Wage Act, a prerequisite for bringing
such an action.
