Don Sensabaugh and David Givens secured the voluntary dismissal of a medical malpractice case where the plaintiff alleged that the defendant physician negligently performed coronary artery bypass surgery. The case was on trial before the Circuit Court of Ohio County, West Virginia. After substantial discovery, the case proceeded to trial. During Mr. Sensabaugh's cross-examination of the plaintiff's expert witness, the plaintiff decided to voluntarily dismiss the lawsuit without settlement.
