Jeffrey M. Wakefield
and
Jaclyn A. Bryk obtained summary judgment for an insurance company on an assault and battery exclusion endorsement contained in a commercial general liability policy. As a result, Mr. Wakefield and Ms. Bryk also obtained the dismissal of the corresponding bad faith claims. This case was the first time West Virginia courts have analyzed this type of assault and battery exclusion.
