The plaintiff alleged that the defendant radiologist breached the standard of care by failing to properly interpret an x-ray of her spine after she had injured it due to a fall at her home.
The defense
argued that defendant radiologist properly diagnosed plaintiff's
injury as a compression fracture and that the later diagnosed
retropulsed bone fragment was not viewable on the initial x-ray
interpreted by the defendant radiologist. After substantial discovery
was exchanged and plaintiff's treating physician deposed, plaintiffs
agreed to voluntarily dismiss the lawsuit without settlement.
