Phillip T. Glyptis Presents Risk Management Seminar

On May 27, 2008, Phillip T. Glyptis presented a risk management seminar in Wheeling, West Virginia, to the Ohio County Medical Society. Mr. Glyptis discussed issues relating to professional liability, recordkeeping, recent decisions by the West Virginia Supreme Court of Appeals, and recent updates to the West Virginia Medical Professional Liability Act. The presentation was part of a CME with the Wheeling Area Continuing Medical Education Consortium.

Phillip T. Glyptis was selected by the Defense Trial Counsel of West Virginia to speak at its annual conference at The Resort at Glades Springs, Daniels, West Virginia, in May 2008. Mr. Glyptis spoke to the Young Lawyers Division on how to prepare your doctor client for a deposition. Mr. Glyptis, a fifth-year associate in the Wheeling Office, concentrates his practice on civil litigation, including professional liability. Mr. Glyptis regularly represents physicians, nurses, long term care facilities, nursing homes, hospitals and other health care providers in actions brought under West Virginia's Medical Professional Liability Act and Ohio's Medical Malpractice Act.

Jaclyn A. Bryk speaks at the National Business Institute

Jaclyn A. Bryk spoke at the National Business Institute's "Insurance Law Seminar" on February 14, 2008 in Charleston, West Virginia. Ms. Bryk's presentation, "Establishing the Foundation: Reviewing the Insurance Contract," focused on insurance contract interpretation, identifying the insured, identifying the cause of loss, and exclusions.

Michael Bonasso speaks at Corporate Counsel Symposium

Michael Bonasso spoke at the Corporate Counsel Symposium, a continuing legal education seminar, on the topic of Taming the Litigation Beast presented by the Federation of Defense and Corporate Counsel in Chicago on September 26-28, 2007. Mr. Bonasso's presentation on "Preparing the Corporate Witness for Deposition" was directed to assisting in-house and outside counsel in identifying and preparing company witnesses to testify in deposition and trial. The Symposium, presented annually by the FDCC, is an interactive and cutting edge conference designed to equip corporate in-house counsel with practical ways to manage pretrial and trial issues, control litigation costs, respond to invasive discovery, handle governmental investigations, adapt to current jury trends, and more.

Timothy L. Mayo Hosted Seminar on West Virginia's Bad Faith Law

On September 25th, Timothy L. Mayo hosted a seminar on West Virginia's bad faith law in Columbus, Ohio for several clients. Specifically, the seminar provided an update on the now non-existent third-party bad faith law, first-party extra contractual litigation and underinsured motorist coverage. Administrative regulations and procedures relating to complaints at the West Virginia Insurance Commissioner's Office were also addressed.

Robert Coffield Speaks at a Continuing Legal Education Seminar

Robert Coffield was a featured speaker at a continuing legal education seminar titled "Health Care Information Privacy and Security Monitoring, Audits and Investigations: How to Avoid an Investigation and What You Should Expect If the State or Federal Officials Call" sponsored by Lorman Education Services on September 24, 2007. Mr. Coffield spoke on HIPAA privacy and security enforcement. Specifically, Mr. Coffield provided a refresher on HIPAA enforcement rules and regulations. Mr. Coffield also discussed OCR privacy investigation statistics, best practices on conducting internal investigations, and responding to OCR/CMS investigation. Mark Robinson Serves as Faculty Member for Trial Academy

Mark Robinson was among a number of defense trial lawyers in West Virginia who served as faculty members for the West Virginia Defense Trial Counsel's Trial Academy held September 14 and 15, 2007 in Charleston, WV. The Trial Academy is an intensive two-day lecture and workshop series designed for attorneys who are seeking to hone their trial skills. Mr. Robinson also serves on the Board of Governors of the West Virginia Defense Trial Counsel.

Thomas Flaherty and Eric Silkwood Address the West Virginia Motor Truck Association

On August 6, 2007, Thomas V. Flaherty and Eric L. Silkwood gave a presentation titled "Controlling Liability After an Accident" to the West Virginia Motor Truck Association (www.wvmotortruck.org) at its 75th Annual Convention in Myrtle Beach, South Carolina. The Association is a statewide, non-profit, association of trucking companies, private fleet operators, industry suppliers, and other firms and individuals interested in the well-being of motor transportation at the local, state and national level.

Michele Grinberg Addresses the West Virginia Primary Care Association

On August 2, Michele Grinberg of the health law practice group spoke to members of the West Virginia Primary Care Association at their annual meeting at Oglebay Park, Wheeling, WV. Ms. Grinberg's presentation entitled: "Termination Station" addressed employer considerations and preparation when it becomes necessary to terminate an employee. Ms. Grinberg frequently advises her healthcare and nonprofit association clients on employment matters.

Members Speak on Insurance Law for the National Business Institute

Thomas V. Flaherty , Erica M. Baumgras , and Tammy H. Harvey presented at the National Business Institute's Insurance Coverage Litigation continuing legal eduation seminar on June 26, 2007, in Charleston, West Virginia. Mr. Flaherty addressed third-party bad faith litigation and interpreting coverage under the insurance contract, while Ms. Baumgras addressed first-party bad faith litigation. Ms. Harvey addressed common types of insurance coverage disputes. The National Business Institute is currently one of the largest providers of legal and professional education in the nation serving over one million professionals.

Tom Flaherty and Chris Brumley Spoke on Litigating Intentional Injury Cases at the Energy & Mineral Law Foundation's 28th Annual Institute.

On May 27, 2007, Tom Flaherty and Chris Brumley spoke on litigating intentional injury (or "deliberate intent") cases at the Energy and Mineral Law Foundation's ("EMLF") 28th Annual Institute in Charleston, South Carolina. The presentation was based on an article authored by them and associate Nate Tawney entitled Employers' Immunity Under Workers' Compensation Statutes: Deal or No Deal? The article covers the history and development of intentional injury exceptions to employer immunity under workers' compensation schemes and discusses litigation trends and tips for such cases. The article will appear in the EMLF's Twenty-Eighth Annual Institute journal later this year.

Bob Coffield, a health care attorney in the firm's Charleston office, presented "West Virginia's Prompt Payment Act and Other Health Law Developments for West Virginia Hospitals." Bob's presentation provided an overview of the West Virginia Prompt Payment Act and other recent legal developments impacting West Virginia hospitals and health care providers. Alaina Crislip, a health care associate in the firm's Charleston office, presented "Statutory Liens for Health Care Providers: The Applicability and Effectiveness of Providers Asserting Liens on Settlements or Judgments From Third Party Tortfeasors." During her presentation, Alaina discussed health care lien law, its effectiveness in other states, and its applicability to West Virginia. Amy Rothman, an associate in the health care practice group, presented "Anti-Fraud Compliance: How Recent Changes in the Deficit Reduction Act Effect Health Care Providers." Amy's presentation explored the scope of the False Claims Act, the recent changes to the Deficit Reduction Act regarding anti-fraud compliance, and West Virginia's current false claim law.
